The Commonhold and Leasehold Reform Act 2002
The Commonhold and Leasehold Reform Act 2002 provides a right for leaseholders to force the transfer of the landlord’s management functions to a special company set up by them – the right to manage company.
This right was introduced in order to empower leaseholders to take responsibility of their property and make their own decisions on who to appoint on the management of their block. They are able to move away from their management company who they were forced to stay with prior to the right to manage process.
This right is only available to flats.
Leaseholders are able to exercise this right whether or not their existing landlord is good or bad.
The process is relatively simple however there are a lot of issues to consider in order for the right to manage to be successful.
